A discussion of lawyer’s unethical arbitration conduct addressed in polls, literature, case law, Florida Bar Rules, other ethical rules, and experiential observations of the panel. Specific ethical discussions will include: 1) lawyer’s responsibilities as an officer of the court; 2) lawyer’s responsibility to perceive and protect the image of the profession; 3) lawyer’s responsibility to the public and 4) lawyer’s duty to be informed about Arbitration and to counsel clients accordingly. Additionally, we will discuss what arbitrators and/or the courts and/or the Florida Bar can do in response to unethical behavior? How does confidentiality and forum rules in administered cases impact this discussion? What can you do if you find that you do not have an independent, neutral or impartial arbitrator? This webinar will improve the attorney’s understanding of the ethical responsibility and requirements in arbitration for all practice areas that utilize arbitration.
