The “Going and Coming” Rule bars compensability of accidents suffered by workers while going to work, or coming from work, after the day is done. The Rule is codified in Section 440.092(2), Florida Statutes. As straightforward as it may seem initially, decades of accidents and litigation have resulted a wealth of (sometimes) confusing case law. This seminar aims to explore some of the historical precedent underlying this rule. It also analyzes the relationships between the “going and coming rule” and related workers’ compensation concepts, including the premises rule, special errand/ dual purpose doctrine, and the “traveling employees” statutory authority and case law. This seminar will explore recent decisions that attempt to define broadly when the working day begins and when it ends.
