This course will address the process of pursuing a partition action in Florida. It will cover the applicability, pursuit, and litigation of partition in-kind and partition by sale. It will address the existence, applicability, and process of partition within the Uniform Partition of Heirs Property Act which came into effect on July 1, 2020. It will further address the law, process, and litigation of claims for contribution for expenses incurred and the value of improvements made by less than all of the coowners, for rentals received by less than all of the co-owners, and for claims for rental value against an actually-possessing co-owner (and the requirements therefore, such as ouster). It will also address the potential award of attorney fees (and what portions of the case they can be awarded for). Practical advice on resolving disputes and the interpersonal contexts (such as frustrated heirs & break-ups) in which they arise will also be addressed.
