Special magistrates are adjuncts of the Court. Today, the labyrinthine aspects of electronic discovery, the increasing complexity of litigation generally, and ever-burgeoning judicial dockets have created fertile ground for the utilization of court-appointed special magistrates. Additional expansion of the role of special magistrates seems inevitable—whether under Civil Rule 1.490, Family Rule 12.492, or Probate Rule 5.697. This presentation is intended as an overview of the Florida Rules of Court governing court-appointed special magistrates. It is also intended as a practice guide for judges and attorneys utilizing the process, with special emphasis on the need for carefully crafted orders of appointment.
