Preserving harmful legal error is necessary to success on appeal, and workers’ compensation is no different. Not all errors are reversible errors. Practitioners must understand that success on appeal requires that two necessary elements be established. First, errors must be harmful. Second, most all errors, with certain exceptions, must be preserved. We will discuss these concepts along with standards of review by which appellate courts look at appeals.
