AI, augmented reality, and nanotechnology have progressed to the point that personal data can be used to digitally resurrect the deceased by re-creating appearance, voice, emotion, and memory to allow digital interactions with images and personas that may be indistinguishable from a living person. Regulation in the intersection of death, technology, and privacy law has remained relatively ignored until recently – and what of the application for those who are among the living but incapacitated? This presentation will explore the policy regarding privacy during incapacity and after death and proposed paradigms for future regulation.
